This Privacy Policy, together with earKART Private Limited (hereinafter referred to as “earKART” or the “Company”) Terms of Use, Dealer Enrolment Form, Customer Terms and Conditions, and any other guidelines connected with the use of the Platform, constitute a legally binding agreement (the “Agreement”) between the Dealer or the Customer (collectively referred to as “You” and “User”) and the Platform in relation to your use of the Services.

This Privacy Policy applies to the Website and the Mobile Application (collectively referred to as “Platform”) which is engaged in the business of hosting a Platform for connecting Customers interested to get a hearing health check-up and purchasing hearing aids, with authorized clinics selling such hearing aids. earKART is concerned about the privacy of the Customers on the Platform and has provided this Privacy Policy to familiarize you with the manner in which the Platform collects, uses, stores discloses, and transfers Your Personal Information (as defined below) collected through the Platform. 

Information we collect

The Platform seeks to provide the Customers with information details of prospective hearing aid clinics located in their vicinity or area of operation.  Simultaneously, the Platform also acquires information from the Dealers in order to register them on the Platform, in order to provide their details to the prospective Customers. For the aforementioned to be possible, it is essential for the Website to collect and use certain information from the Customers and Dealers. The Platform may collect Personal Identification information as well as non-personal identification information from both the Customers and Dealers. 

The personal identification information includes, but is not limited to, your e-mail address, name, location address, telephone number, and other appropriate details that would help the Platform in verifying your Identity. You agree that the information collected by the Platform is submitted willingly by you. 

The objective behind collecting your personal information is to provide better services and to perform various site-related activities with greater convenience and efficiency. The Platform collects personal identification information not only in order to register Customers and Dealers on the Platform but to also keep a record of the services sought by the Customers, services provided by the Dealers, and for performing other Platform related activities. Due to the nature of services provided by earKART, the Platform may disclose your personal information to third parties, with your explicit consent, in order to provide you with the best information for which you accessed the Platform’s service. 

The Platform may also disclose information in response to a court order or government request, or when it would be reasonably necessary to disclose the said information to protect the rights of the Platform, third parties, or the public at large. The Platform may disclose information to comply with legal process, to enforce their Terms of Use, to protect their operations and rights, privacy and safety of the properties, and to pursue any available legal remedies. 

The non-personal identifiable information such as your IP address, browser type, domain names, access times, and referring website addresses are automatically collected from Visitors or Customers when you interact with the Platform.

Web Browser Cookies

A cookie is a small piece of text file stored by the website/ Mobile Application on a user’s device when the Platform is opened. The Platform uses cookies to improve the quality interaction of Customers and Dealers with the Platform and allows you to enjoy the Platform more. The Platform may use cookies to store a unique identifier for logged-in Customers to enhance user experience, such as when you use the password-protected pages of the Platform. If you chose to disable the cookies, you might not be able to fully experience the interactive features of the Website. 

Advertisements and third-party sites

Some of the advertisements, if at all you may see on the Platform, are selected and delivered by third parties, such as advertisement networks, advertising agencies, advertisers, and audience segment providers. These third parties may collect information from you during the course of your online activities, either on the Platform or on other websites, through cookies, web beacons, and other technologies in an effort to understand your interests and deliver to you advertisements that are tailored to your interests. The Platform does not have access to, or control over, the information these third parties may collect. The information practices of these third parties are not covered by this Privacy Policy. The Platform would not be liable for any loss or damage caused to you as a result of such third parties collecting such Personal Information, or any other types of information from you. 

The Platform also does not make any representations regarding the availability and performance of any of the external sites that the Platform may provide to you during any interactions with them. The Platform are not responsible for the content, terms of use, privacy policies, and practices of such third-party websites.

Use of information collected to process payments

If you decide to avail of our services on the Platform, we collect some additional information in order to complete the transaction. We collect information such as billing address, a credit/debit number, credit/debit expiration date, details related to UPI/ Payment wallet, and other necessary payment details to process the payments. You can be assured that Cashfree & RazzorPay, the Platform’s trusted gateway partner uses secure encryption technology in order to keep your transactional details confidential at all times. These gateways are managed by leading Banks that use the 3D Secure password service, created by you, to provide an additional layer of security to our online transactions.  

While availing any of the payment method(s) available on the Website, the Platform will not assume liability, monetary or consequential, for any loss caused to you due to payment issues arising out of the transactions.

Protecting Information 

earKART works to protect the security of personal information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input in addition to maintaining the security of your information as per the IT Act, 2000 and the Rules. We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal information (including sensitive personal information). 

It is important for you to take steps to protect against unauthorized access to your account. You should keep confidential your password, security questions, and any other credentials used to access your account (your "Credentials"). The security of your account with earKART relies on the protection of your Credentials. DO NOT SHARE YOUR CREDENTIALS. If you do share your Credentials with a third party for any reason, the third party may have access to your account and your personal information, and you may be responsible for actions taken using your Credentials. If you believe someone else has obtained access to your Credentials, please change them immediately by logging in to your account and changing your Profile settings, and also contact us right away.

Changes to this Privacy Policy

The Platform has the discretion to make amendments in the privacy policy as it may deem fit, without any prior notice. You will be sent an email in order to notify you of the changes being made. Continued use of the Platform, even after the changes made, shall constitute your acceptance of the change. Therefore, the User is asked to review this Privacy Policy frequently and stay aware of changes being made in it.
